New evidence moves court appearance

Video footage of Alfred Zwack, the driver charged in the hit-and-run accident which killed Saint Rose student Etemowei James Oki on Nov. 26, is under review by the Albany County District Attorney’s office.
Police secured recorded images of Zwack and his car both before and during the accident on Quail and Elk streets at 1:42 that morning.
“There’s an actual video of the crash and there’s video of him at a gas station,” Shannon Corbitt, an assistant district attorney, told The Chronicle.
Some of the images were recorded near the IBB Food Mart, a gas station at 615 Clinton Ave., according to the District Attorney’s office. Police interviewed Mohammed Naag, the night manager at the IBB who was on duty during the early morning hours when Oki was hit.
“The accident occurred two blocks from our store,” Naag said in an interview. He does not remember if Zwack came into the store.
Zwack, 19, is in Albany County Jail without bail on charges of leaving the scene of an accident, reckless driving, unlicensed operation of a vehicle, and operating a motor vehicle without a license. His case will be handled by the vehicular crimes division under Assistant District Attorney Mary Tanner-Richter.
Joseph McCoy, Zwack’s attorney, declined a Chronicle request to interview Zwack.
Last Thursday, Zwack waived his right to a preliminary hearing in Albany City Court.
